FAQ

VCAT Expert Witness Reports in Strathtulloh: common questions

Do I need a certificate from the Building and Plumbing Commission before VCAT?

In most cases you do. Before a party can apply to VCAT about a domestic building work dispute, the Building and Plumbing Commission's dispute resolution service (formerly DBDRV) must issue a certificate of conciliation stating the dispute was not suitable for conciliation or was not resolved. Applications for an injunction do not need one. First, though, put the defects to your builder in writing.

Can the same report be used in conciliation?

Yes, and it helps. Because it sets out each defect, the requirement it fails and the remedy, the conciliation officer and the builder have specific items to address, and the service can appoint its own assessor to inspect as well. For a VCAT application, the building disputes practice note asks you to include any expert report you have on the defective or incomplete work.

Will the expert argue my case?

No. Under PNVCAT2 an expert witness owes a paramount duty to VCAT rather than to the party who engaged them, and must not act as an advocate. So the report states where work is acceptable as plainly as where it is not.

What must the report contain under PNVCAT2?

It needs a summary of opinions, the expert's qualifications and experience, all instructions given, the facts and assumptions it relies on, the documents reviewed, any issue outside the expert's field and a signed declaration. Wherever rectification is recommended, the reasons, the likely cost and whether a reasonable alternative exists must be given. Photographs, measurements and the relevant clause back up every item.

How is the work on a Strathtulloh home assessed?

Against the contract documents first, since section 8 of the Domestic Building Contracts Act 1995 implies warranties that the work matches the plans and specifications, complies with the law including the Building Act 1993, and is carried out with reasonable care and skill. Then against the National Construction Code and Australian Standards, among them AS 2870 for slabs on the basalt clay, AS 3740 for wet areas and AS 1684 for timber framing. The Guide to Standards and Tolerances sets the measure for tolerances and finishes.

Does the 2026 Guide to Standards and Tolerances apply to my house?

Only if the contract was entered into, or the work started, on or after 1 August 2026. A home built under an earlier Strathtulloh contract is assessed against the 2015 Guide. Being advisory, the Guide yields to the contract, the law, the NCC or a standard where they differ.

Is it too late to pursue the builder?

Possibly not. A building action cannot be brought more than 10 years after the occupancy permit was issued, or the certificate of final inspection if there was no occupancy permit, under section 134 of the Building Act 1993. The section 8 warranties also pass to later owners, so the buyer of an established Strathtulloh home can rely on them within that period.

Do you sit down with the builder's expert?

Where VCAT directs it, yes. Experts may be ordered to confer in a conclave, narrow the differences between them in good faith and file a joint report setting out the points agreed, the points not agreed and the reasons, which is sometimes called a Scott Schedule. The report is usually taken as read at a more complex hearing, and the tribunal may take evidence from the experts together as a panel.

When must the report be filed and served?

On the date VCAT's orders give. If there is none, PNVCAT2 sets a minimum of 10 business days before the mediation, compulsory conference or hearing at which the report will be relied on. Late reports may be refused, so give us the tribunal dates as soon as you have them.

Who will prepare my report?

The report is prepared by an experienced building inspector, who visits the house, goes through your documents and signs the PNVCAT2 declaration. The report states the inspector's qualifications and any relationship with you, as VCAT requires.

Do you take on reports beyond Strathtulloh, and how do you price them?

Yes, in Melton South, Cobblebank, Thornhill Park, Weir Views and Melton as well as across the Strathtulloh estates. The fee depends on the number of disputed items, the size of the home and the documents to work through. A quote follows once we have read your contract and defect list.
